Please read these terms of use carefully. By using the site, you accept these terms of use and agree to be bound by them (and any variations properly made to them). If you do not agree to these terms of use, please refrain from using the site.

ACCESSING THE SITE
Access to the site is permitted on a temporary basis and we reserve the right to withdraw or amend the site without notice. We will not be liable if, for any reason, the site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the site or the entire site.
When using the site, you agree:
- to abide by all laws (including without limitation data protection and intellectual property laws), regulations and codes of conduct that are applicable to you;
- not to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); and
- not to damage, interfere with or disrupt access to the site or do anything which may interrupt or impair its functionality.
You agree to treat any username, password or any other piece of information allocated to you as part of our security procedures as confidential and you must not disclose it to any third party. We have the right to disable your user name or password at any time if, in our opinion, you have failed to comply with any of these terms of use.
THE SERVICES
Certain services have been made available to you through the site. These services include virtual meeting facilities and a private cloud storage service (own cloud) (together, the "Services").
You may use any of the Services in relation to your Jamati voluntary work only.We reserve the right to withdraw or amend the Services at any time without notice. We will not be liable or responsible if, for any reason, any Service is unavailable at any time or for any period. From time to time, we may restrict access to one or more of the Services for any reason.
INTELLECTUAL PROPERTY RIGHTS
- The copyright and all other rights in all of the material on this website are owned by the Ismaili Council for Kenya. All such rights are reserved.
- External trademarks are included as part of this website with the consent and permission of the trademark owners.
- You may not print off any page(s) from our site without our prior permission unless in relation to your own personal or household's information.
THE SITE MAY CHANGE
We aim to update the site as necessary and may change the content at any time. Any of the material on the site may be out of date at any given time and we are under no obligation to update such material.
OUR LIABILITY
The information displayed on the site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, and any third parties connected to us, hereby expressly exclude:
- a) all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity; and
- b) any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with the site or in connection with the use, inability to use, or results of the use of the site, any websites linked to it and any materials posted on it, whether caused by tort (including negligence) or otherwise, even if foreseeable.
This does not affect our liability for death or personal injury arising from our negligence nor any other liability which cannot be excluded or limited under applicable law.
INFORMATION ABOUT YOU AND YOUR VISITS TO OUR SITE
We process information about you in accordance with our privacy policy. By using the site, you consent to such processing and you warrant that all data provided by you is accurate.
UPLOADING INFORMATION OR MATERIAL TO OUR SITE
Whenever you upload information or materials to our site (including using the private cloud storage Service, you must comply with the following content standards:
Information or materials must:
- be accurate (where they state facts);
- be genuinely held (where they state opinions); and
- comply with applicable law in Kenya and in any country from which they are posted.
Information or materials must not:
- be deliberately misleading;
- be used to misrepresent your identity (or that of anyone in your household) or affiliation with any person, or be used to impersonate any person;
- contain any material which is defamatory of any person;
- contain any material which is obscene, offensive, hateful or inflammatory;
- infringe any copyright, database right or trade mark of any other person;
- be likely to deceive any person;
- be provided in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
- promote any illegal activity;
- be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
- be likely to harass, upset, embarrass, alarm or annoy any other person;
- give the impression that they emanate from us, if this is not the case; or
- advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
You warrant that any such information or materials comply with the above standards and you indemnify us for any breach of that warranty.We will not be responsible, or liable to any third party, for the content or accuracy of any information or materials posted by you on our site.
We have the right to remove any information or material you upload on our site if, in our opinion, it does not comply with the content standards set out above.
VIRUSES, HACKING AND OTHER OFFENCES
You must not misuse the site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which the site is stored or any server, computer or database connected to the site. You must not attack the site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of the site or to your downloading of any material posted on it, or on any website linked to it.
LINKING TO THE SITE
You may not under any circumstances create a link to the home page or any part of the site. The site must not be framed on any other site.

Where the site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

SUSPENSION AND TERMINATION
- We will determine, in our discretion, whether there has been a breach of these terms of use through your use of the site. When a breach of these terms has occurred, we may take such action as we deem appropriate, including without limitation:
- immediate, temporary or permanent withdrawal of your right to use the site;
- issue of a warning to you;
- legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
- further legal action against you; or
- disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
JURISDICTION AND APPLICABLE LAW
The Kenyan courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Kenya.
VARIATIONS
We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

We are committed to protecting and respecting your privacy.
This policy (together with our terms of use and cookies policy) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. This policy is effective from July 2016.
If you are completing the registration process in your capacity as head of your household (or as a nominated adult), please note that this privacy policy applies to you as an individual rather than to your household. Where possible, the individual members of your household should log onto the site and indicate their preferences. If you wish, you may print a copy of this privacy policy for your reference or to share with members of your household.
For the purposes of the Data Protection Act 1998, the data controller is the Ismaili Council for Kenya, which includes the institutional Boards*, Institutional Portfolios and any associated bodies ('we' or 'us'). We may collect and process the information that you give us as follows:
- to profile individuals for Jamati service;
- to profile the Jamat’s requirements to ensure adequate and relevant provision of Jamati and institutional services, events and programmes;
- to provide and manage Jamati institutional services, events and programmes; and
- for administrative and organisational purposes.
We may also use your details to contact you to complete surveys that we use for research and evaluation purposes and to provide you with information about future events, services or programmes of the Ismaili Council Kenya which may be of interest to you and we may contact you about these by post, telephone, email or SMS.

Opting Out

Disclosure
We will not disclose your personal information to anyone except:
- within the Ismaili Council for Kenya (including its Boards, Portfolios and associated bodies) in accordance with this privacy policy;
- to institutions affiliated with the Ismaili Imamat (as described in this privacy policy), unless you have ticked the box to tell us that you do not want to receive information from them;
- where we are required by law to disclose or need to disclose for legal purposes (such as to obtain legal advice); or

If you wish us to delete all of your details from the site, please send your request in writing to the attention of Executive Officer, at Ismaili Council for Kenya Offices located at Darkhana Jamatkhana Parklands, Limuru Road, Nairobi. Please note that if you request us to delete all of your details from the site, you may not re-register on the site for a period of six months from the date of deletion.
